essentially inflicted in the initial period of detention, situations of mistreatment in later
stages of detention were also detected. While there are a considerable number of
administrative orders regulating the treatment of detainees, their effective implementation
requires the establishment of enforcement and monitoring mechanisms.
Based on meetings with decision-makers, victims and civil society representatives,
the Special Rapporteur identified two overarching issues critical to effectively combating
torture and ill-treatment that need the urgent attention of the Government to ensure justice
in times of a successful transition: first, prompt and thorough investigations into all cases of
torture and ill-treatment, prosecution of the perpetrators, and the provision of effective
remedies and reparations, including rehabilitation services, for all victims of torture and illtreatment; second, the establishment of solid safeguards against torture and ill-treatment
through the swift introduction of constitutional, legislative and administrative reforms.
In this context, regarding the violations committed during the Ben Ali regime, the
Special Rapporteur recommends adequate and thorough investigations into all cases of
torture, the prosecution of perpetrators, and the provision of reparation and rehabilitation
services for victims. Regarding the abuses committed during the revolution and its
aftermath, the Special Rapporteur recommends that the fact-finding commission
established to investigate those events complete its work as soon as possible and that its
findings be followed by investigations and prosecutions, when warranted, without further
delay, and that victims receive adequate reparation and rehabilitation. Regarding the
prevention of torture, the Special Rapporteur recommends that constitutional, legislative
and administrative reforms be expedited to ensure the establishment of solid safeguards
against torture and ill-treatment.
The Special Rapporteur calls upon the international community to assist Tunisia in
its fight against torture and ill-treatment by providing financial and technical support.
