Covenant on Civil and Political Rights,
Meeting on 5 November 2015,
Having concluded its consideration of communication No. 2366/2014 submitted to it
by X under the Optional Protocol to the International Covenant on Civil and Political
Rights,
Having taken into account all written information made available to it by the author
of the communication and the State party,
Adopts the following:
Views under article 5 (4) of the Optional Protocol
1.1
The author of the communication is X, a Bangladeshi national born in 1969 and
currently residing in Canada. The author is subject to deportation following the rejection of
his application for refugee status in Canada. He asserts that by removing him to
Bangladesh, the State party would violate his rights under articles 6 (1), 7, 9 (1), 19 (1) and
(2), and 26 of the Covenant. The first Optional Protocol to the Covenant entered into force
for Canada on 19 May 1976. He is represented by counsel, Joseph W. Allen.
1.2
On 19 March 2014, pursuant to rules 92 and 97 of its rules of procedure, the
Committee, acting through its Special Rapporteur on new communications and interim
measures, requested the State party not to remove the author to Bangladesh while the
communication is under consideration by the Committee. On 1 September 2015, the
