The author of the communication is Sharmila Tripathi, who submits the communication on her own behalf and that of her husband Gyanendra Tripathi and their minor daughter C.T. They are Nepalese nationals, born on 1 January 1969, 8 June 1969 and 21 January 2002, respectively. The author claims that the State party has violated Mr. Tripathi’s rights under articles 6; 7; 9, paragraphs 1–4; 10, paragraph 1; 16 and 22, alone and read in conjunction with article 2, paragraph 3, of the International Covenant on Civil and Political Rights; the author’s rights under article 7, read in conjunction with article 2, paragraph 3, of the Covenant; and her minor daughter’s rights under article 7, read in conjunction with articles 2, paragraph 3, and 24, paragraph 1, of the Covenant.
