The author of the communication is Mamatkarim Ernazarov, a national of Kyrgyzstan, born on 2 July 1967. The communication is presented on behalf of the author’s brother, Rakhmonberdi Ernazarov (deceased). The author claims that his brother’s rights under articles 6 (1) and 7, read alone and in conjunction with article 2 (3) of the Covenant, were violated.1 The author is represented by counsel. The facts as presented by the author 2.1 The author’s brother was arrested on 4 November 2005, as a result of a complaint that he had committed forced sodomy against the father of his former girlfriend.
