CAT/C/42/D/324/2007 Page 2 ANNEX DECISION OF THE COMMITTEE AGAINST TORTURE UNDER ARTICLE 22 OF THE CONVENTION AGAINST TORTURE AND OTHER CRUEL, INHUMAN OR DEGRADING TREATMENT OR PUNISHMENT Forty - second session Concerning Communication No. 324/2007 Submitted by: Mr. X (represented by counsel) Alleged victim: The complainant State party: Australia Date of the complaint: 2 May 2007 (initial submission) The Committee against Torture, established under Article 17 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, Meeting on 30 April 2009, Having concluded its consideration of complaint No. 324/2007 submitted to the Committee against Torture on behalf of Mr. X under article 22 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, Having taken into account all information made available to it by the complainant, her counsel and the State party, Adopts the following decision under article 22, paragraph 7, of the Convention against Torture. 1.1 The author of the communication dated 2 May 2007 is Mr. X, a Palestinian born in Lebanon in 1960, detained at the Villawood Detention Centre (Australia). He sought political asylum in Australia; his request was rejected, and he risks forcible removal to Lebanon. He claims that by deporting him, Australia would violate his rights under article 3 of the Convention against Torture. He is represented by counsel. 1.2 While registering the communication on 27 June 2007, and pursuant to rule 108 of its rules of procedures, the Committee, acting through its Special Rapporteur on new communications and interim measures, requested the State party not to expel the complainant while his case is under consideration.
