The complainant is K.V., a national of Sri Lanka national born in 1992. He claims
that his deportation to Sri Lanka would constitute a violation by Australia of his rights
under article 3 of the Convention. The complainant is not represented by counsel.
1.2
On 8 May 2014, in application of rule 114 (1) of its rules of procedure, the
Committee, through its Rapporteur on new complaints and interim measures, requested the
State party to refrain from returning the complainant to Sri Lanka while his complaint was
being considered by the Committee. On 13 June 2016, the Committee, acting through the
same Rapporteur, denied the State party’s request to lift interim measures.
