The complainant is T, a Sri Lankan national born in Batticaloa in 1988. He claims
that his deportation to Sri Lanka would constitute a violation by Australia of article 3 of the
Convention. The complainant is represented by counsel, Michaela Byers. Australia made
the declaration under article 22 of the Convention on 28 January 1993.

On 2 May 2014, in application of rule 114 (1) of its rules of procedure, the
Committee requested the State party not to deport the complainant to Sri Lanka while his
complaint was being considered by the Committee. On 21 May 2015, the State party
requested the Committee to lift the interim measures. On 26 October 2015, the Committee
denied the State party’s request to lift the interim measures. On 25 February 2016, the State
party requested that the communication be considered by the Committee as soon as
possible.
